The Harman obligation is a key legal principle that restricts the use of documents obtained in the course of litigation. Issues around using such material for other proceedings or purposes arise frequently in practice and breaches can carry serious consequences.
In this presentation, Susanna and Antonia will outline the history and development of the Harman obligation in Australia, explain who is bound by it and the role of “compulsion” and clarify the types of documents and proceedings to which it applies. They will also discuss the consequences of a breach, how to seek relief and how the obligation operates in an insurance context, drawing on recent case law.
