Overview

Our Commercial & Retail Leasing team offers market-leading legal services to landlords and tenants from both the public and private sectors. This includes local and other government authorities, educational institutions, ASX listed companies, developers, institutional investors, property trusts and SME's.

We aim to collaborate closely with our clients to understand their needs and to deliver an efficient service, with attention to detail and, where required, high-level, accessible advice.

Our leasing practice is part of the foundation of our Property & Development group with some of our lawyers  recognised in Australia for their leasing expertise in industry awards.

We regularly act for landlords regarding:

  • leasing of commercial office buildings, retail shopping centres, business parks and industrial properties. Our leasing service includes drafting and negotiating stream leases and ancillary documents including lease variations, assignments, subleases and surrenders, car parking licences, incentive and fitout deeds, signage and naming rights agreements
  • advising on various aspects of leasing portfolio management
  • advising on legal ramifications of refurbishment and redevelopment of existing shopping centres and commercial buildings
  • providing advice in relation to retail leases and the legislative regimes prescribed in the different jurisdictions of Australia
  • interpretation of obligations of parties pursuant to leases, enforcement of leases and tenant disputes.

We work with many tenants negotiating leases, from start-up businesses to publicly listed corporations. This requires a deep understanding of our client's desired business outcomes and the risks to be managed, to ensure our client's particular requirements are met within the leasing terms.

Our experience includes one-off leasing transactions which involve complex, tailored leasing documentation for purpose built facilities. These include deals for commercial buildings under construction, data centres, telecommunications infrastructure, hospitals, medical centres, stadiums and sports facilities, car parks, universities, child care centres and licensed venues.

In addition, we provide advice on other areas of law which directly impact on leasing, such as taxation, tenant disputes and defaults, construction contracts, town planning and relevant leasing legislation such as the building energy efficient and electricity regulation laws.

We consult with our clients to develop leasing documents and reporting systems which are tailored specifically to our clients' needs. We have developed an easy-to-use, secure online status reporting system for leasing clients who manage large portfolios to  streamline  communication and accessibility of critical lease documents.
