Legal malpractice

Overview

Our Insurance group has significant and distinct experience in defending and supporting solicitors, barristers, licensed conveyancers and law practices in relation to professional indemnity  claims and disciplinary matters.

We appreciate the sensitive, complex issues that can arise in these matters and understand how important it is to effectively and empathetically manage the expectations of both the sophisticated professional and their insurers.

We advise on legal malpractice claims that have the potential to result in significant professional, reputational and economic consequences.

We focus on being commercially pragmatic, identifying quickly the key issues and evidence, and settling legitimate claims early where possible through alternative dispute resolution (ADR) processes. When needed, we will also robustly defend unreasonable or unmeritorious claims through litigation.

We are also able to draw on other expertise within our wider practice to provide insights into areas of law, where appropriate, to help shape claims strategy.

Our experience spans the key areas of legal practice typically seen in legal malpractice claims, including:

  • residential and commercial property transactions
  • commercial litigation, including applications for personal costs orders
  • building and construction projects
  • personal injury matters
  • cyber fraud
  • commercial transactions
  • mortgages, loans and guarantees
  • family law, and
  • drafting of wills, powers of attorney, and testator's family maintenance matters.

Many partners in our team are recognised in Best Lawyers in Australia in Professional Malpractice Litigation for their expertise.
