Overview
Our Insurance group blends expertise with empathy when defending medical and allied health practitioners in malpractice and other claims, regulatory complaints, inquiries and coronial inquests. We have advised on everything from small complaints to alleged catastrophic physical and psychological injuries to patients.
We have defended many hundreds of malpractice claims against medical practitioners and allied health professionals and are experienced in managing the complex and technical medical issues that often arise including the interpretation of insurance policies with complex wording given the multidisciplinary nature of this field.
There are often high levels of reputational risk and personal stress associated with allied health and medical claims, complaints, inquiries and inquests. We work closely with insurers and practitioners to support and guide them as they deal with these sensitive issues.
In addition to acting for medical practitioners, our experience includes defending medical and allied health providers such as optometrists, chiropractors, physiotherapists, radiologists, psychologists, counsellors and pharmacists. We also commonly defend matters on behalf of medical centres, residential aged care providers, IVF providers and a multitude of other healthcare practices. We regularly advise on:
- malpractice claims
- administrative errors & omissions liability (E&O) claims
- complaints made to Australian Health Practitioner Registration Authority (AHPRA) and state health complaint bodies
- fraud, including employee fraud and Medicare fraud
- privacy issues, and
- inquiries and coronial inquests.
We have fostered strong relationships with many of the best experts, who can play an instrumental role in achieving claims outcomes.
Whether the issues are straightforward, novel, highly contentious or complex our team provides advice and guidance with a thorough understanding of the law and medical practice.
